In my company, we have an official working time 10 am to 8 pm, with break time 1:30 pm to 2:15 pm and eve 6to 6:15 pm. Is it right as per labor law rule? We come under the shop establishment act, we are an IT networking product dealer and distributor. Only deals in the international market. Are there any specific rules for salary calculation? In our company we have started with a sudden rule of 26 days for salary calculation, first, we used to calculate salary and do deduction on a pro-rata basis i.e If anyone comes late beyond 10 am 3 days grace period 15 min each or 45 min whichever is earlier was given, and on pro-rata basis time was added and minutes wise salary was breaded down and deductions were calculated, now they are deducting salary 3 late marks half day + pro-rata basis deductions even, are this practice legal and authenticated or illegal practice. Any specific rules for it.

PLEASE guide me PLEASE !!!!!

Your first part of the query is clear and since the total spread over (including intervals of rest) is 10 hours, there is no illegality. You can have 10 hours and 30 minutes. Only thing is that the hours that each employee works (physically works) should not exceed 9 hours a day or 48 hours a week. If you work for 5 days, then it will come to 45 hours only and that is okay. However, if you have 6 days with each day contributing to 9 hours, then it will be against the law.

The second part of your query is not clear and regret I am not in a position to answer to it

Thank you for your reply, sir!

But there is a violation of one law the Women working law, As per law any woman should not be working beyond 7 pm and if she is working beyond then proper arrangement for her has to be made to drop her home from the office.

If any woman employee stays back after 7 pm, naturally, it will become a non compliance and that can be taken up to the management.
