Legally correct methods of suspending employee are two. One, suspension pending enquiry, and two suspension after charge defined as misconduct is proved.
1) Employee can be suspended pending enquiry only if the alleged charges are so grave that the employee's presence is detrimental.
2) Such charge shoved be proved by conducting domestic enquiry and enquiry officer's finding should mention that the charge of misconduct is proved. Maximum 4 days suspension can be awarded for a proved misconduct.
In case 1) domestic enquiry should commence soon after issuing order of suspension pending enquiry.
There can be no other way that employee can be legally suspended.
