Hello,

Can basic salary be less than the minimum wages?

Suppose as per Gujarat minimum wages act, a skilled employee should get 14220 per month.

So if an employee has the CTC of 20500 and his basic+DA is 10000.

Is that legal? or we will have to keep basic + da as per the minimum wages act?

Kindly provide your valuable opinion.

Hi It is advisable to maintain the Basic wages not lesser than the prescribed Minimum wages

The basic salary should not be less than the notified rate of minimum wages.
It is the right of workman to claim minimum wages, should complain before the authority, if denied by the employer.
Further, it is the work of HR to ensure that workmen should get legitimate wages as per statute. Failing of which shall be treated as malfunction of HR.

Any worker "s salary should not be less than the wages fixed. /revised by the concerned state.
Every state labour dept
Revised variable dearness allowance according to raised cpi points every SIXMONTHS. i.e two times in a year.
In the above example Gujarat skilled worker is getting total wage salary Rs14420.
If that salary is lesser than the wage fixed by the state Govt.
Then it is wrong.unless no issue.

Please keep Basic wages same as prescribed in Minimum wages or more than Minimum wages...but should not be less than the prescribed in Minimum wages.
