Respected sir/madam, Last month my sister got an appointment letter from ESIC hospital Kollam as Nursing oderly. Does she eligible for maternity leave ?? her child was only one month old , the authority gave her one month extension, during her last job she was not a ESIC member, If she was not eligible ,does she can apply for child care leave?? kindly help

An Employee will be eligible for all benefits only after Appointment subject to fulfilling conditions.the Authority has already extended joining date by 1 Month considering child birth.Please ask your sister to report for duty on the specified date & there after avail all the facilities/benefits provided therein

Maternity leave is applicable for the female employees who are not covered under ESI scheme and worked for more than 80 days in the organization prior to confirmation of pregnancy hence your sister is not eligible for any type of leave related to & if she is not comfortable to join after one month then now itself ask them for extension.
As per your communication she was not covered under ESI and she was working with some organization in these circumstances why she has not got maternity benefits from that organization. However the conclusion is that the new organization is not liable for sanction of any leave even after she joins after one month / two months also
