Dear Seniors
I have taken a new employee, she has to get registered in ESIC. Her husband is working in Private Company and registered her name in ESIC. Now my question is whether she has to register again from my company OR she can continue with her husband registration.
I think father in Laws and Mother in Laws will not cover in ESIC please correct me if i was wrong.
If she has to register from my company again whether her husband details to entered OR only her name should be register

The registration of every coverable employee under ESI Act is required to be separate and as and when new employee joins his/her particulars on Declaration Form is required to be filled up and submitted to the appropriate Branch Office within 10 days. The employer is responsible for completion of all such formalities.
You can see the columns in the Declaration Form and fill up the same.
Separate Identity Card under ESI Act is required to be issued to all the Insured Persons.
You can contact the appropriate Branch Office of ESIC of your area for forms and further formalities.

PS: Separate Insurance Number will be allotted to all employees regardless of any relationship with any other employee who is already having Insurance Number or is covered. Harsh Kumar Mehta

Lets put a logic here and come to a conclusions that if the employee is not registered in ESIC she will refrain from paying the ESIC Contribution so what will be your justification during audit/ ESIC Inspection. Please think over and you will get your query resolved.

In continuation to the points Mr. HK Mehta has mentioned, I would like to clarify that; this new joinee is your employee. You have to provide / help to get all statutory and other benefits to each every employee subject to the eligibility. You please do not bother whether this lady is covered under her husband's scheme or other family members scheme. For your company she is an eligible and independent employee; so cover her in the ESI scheme. In fact she can cover other family members under her primary membership for benefits.
I could not see coverage of in-laws in the definitions as well as restriction on covering the dependent spouse who is also working. May experts in this subject help in this regard
