Is it legal for a pharmasist or a drug/medicine seller to sell medicines while being drunk at work?

The question of legality apart, being drunk while at work is certainly a misconduct on the part of any employee. Particularly, in the case of a pharmacist or any employee in a pharmacy, its repurcussions are far greater.

The Employer/Superiors On-Duty are accountable for suchan Incident/occurence when any Employed Person Reports to Resume Duty " Ostensibly Drunk / Under Influcence of Intoxicants" and hence the Duty Supervisor also need to be taken to task for Failure to Obey/ Observe Service Rules applicable to the Workplace. Acts of Misconduct in course of and or arising of Emploment Must be effectively Dealt with and Proportionate Punishment awarded.

While concurring with Umakanthan Sir, I would like to add further as under:

Section 85 of Bombay Prohibition Act 1949 says whoever in any street or thoroughfare or public place or in any place to which the public have or are permitted to have access, behaves in a disorderly manner under the influence of drink shall, on conviction, be punished.

Shop is a public place in my view on reading various cases.

Behaving disorderly manner under the influence of drink is phenomena to constitute the offence.

You seems to be from Kolkata and in Kolkata it is common to drink in public place as what I know and what I have seen too. However, until such time anybody does not behaves in a disorderly manner, no cognizance is taken by the police.

Jurisdiction of Bombay Prohibition Act 1949 is extended in Maharashtra. You may be having similar law within every State.

Not only Pharmacist, for that matter, if any person under the influence of liquor, is found at
work place and discharging his/her duty, it is against law and tantamount to gross indiscipline/grave misconduct, and such persons are liable for strict disciplinary procedures.
