Hi!
I have PF account in a company where i worked for 7 months(July'09 to Jan'10), now i want to claim the PF amount.
But the consultant tells that, I cannot claim PF until the company submits the dues if any and state the status of the company(as the there are no employees in the company).
But now the company is relocated and no one to take responsibility to give status of the company.
Kindly suggest me to get my PF amount.

Dear Nusrath Khan,
Please fill Form 19 and get endorsed from the concerned employer. Then directly approach Office of the Regional PF Commissioner. They will tell the correct status. Most probably you will get a positive out come.

Mr. Abbas,
I told my consultant that, I will directly submit Form 19, at EPFO. But he is telling that I am inviting problems, as the officers may dig the files and put a hold on the claim. As the company is not paying any contributions since feb'10, as there are no employees in that company now.
Please suggest

Dear Nusrath Khan,
You have mentioned that since Feb 2010 company is not contributing to PF, as there are no employees. That means in your case full contribution has gone to EPF. Then why you have to bother? There is no rule that employer should be the messenger to hand over the Form 19 to the PF Office. But remember that the formality to submit the Form is first you fill the form and get endorsed from the employer. Ask the PF authorities for acknowledgement on the photo copy.
Why I suggested this method is that when you approach the PF authorities for withdrawal, they will inform you that whether the employer has remitted full dues towards your contribution. If there is a due of one or two months, they can give the balance amount also. (This I convey as per the informations from my RPFC Office).
Ask your cosultant that other than this, what is the remedy. The difficulty will be arised, if the employer was not prompt in remittance. But to know the details either you have to get them from the employer or from the EPF authorities. Then only you can proceed further.
