Hi, I worked for a pvt company XXX Life Care Equipment Pvt Ltd for 5.5 yrs. After I left the job I received FNF and found a 0 amount as my leave encashment. I have an annual leave balance of 30 days and I supposed to pay for that. My company paid the leave encashment for former employees. When I contacted the HR team they are refusing to pay my leave encashed balance stating no leave encashment policy through previous employees were paid. Please let me know my options to complain and need help in this regard. My head office is in Maharastra and I worked in Telangana.

My company manufactures and supply equipment to pharma companies. We get equipment from our factory and we perform service to it. I worked as a field service engineer here.

If your name is borne on the roll of the factory or the Corporate or Marketing Department which is functioning in a different place, in both the cases you are entitled to get encashment of EL at your credit on the date of termination of your employment. It is a statutory obligation of the employer and no policy of his organization can run counter to it. If your last drawn salary was ₹ 24k or less, you can file a claim u/s 15(1) of the Payment of Wages Act,1936 before the DLC for the area; if higher, a claim u/s 33-C(2) of the ID Act,1947 before the Labor Court for the area where you worked.
