In all events, the company must try to help employees while entering parenthood. Is top management fine with this? Check with them first. The policy given by Akanksha seems to cover the necessary requirements. Just remember, if you help the employee, the employee is engaged and will deliver more.

Hi Kirtan,

A couple of companies I have come across allow paternity leave of 7 days to be availed in one instance within 45 days of childbirth. This is also extended in case of adopting a child.

We have offered our male executives the following benefit:

PATERNITY LEAVE AS APPLICABLE (PAT. L):

A male employee with fewer than two surviving children may be granted Paternity Leave for a period of 2 days before or up to 7 days from the date of delivery of the child. During the period of such leave, he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. Paternity Leave shall not be debited against the leave account and may be combined with other kinds of leave, as in the case of maternity leave. If paternity leave is not availed within this period, it will be treated as lapsed.

This is a paid leave.

I do not know about government employees, but none of the labor laws allow us to receive paternity leave or benefits from the employers.

Paternity leave depends on the company policies as there is no express provision under Indian law or statutes. However, the rules address it as follows:

"A male employee with less than two surviving children may be granted Paternity Leave for a period of 15 days during the confinement of his wife. During the period of such leave, he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. Paternity Leave shall not be debited against the leave account and may be combined with other kinds of leave as in the case of Maternity Leave."

What about the paternity leave of an employee who is working in a Limited company? What are the rules, and how many days can he avail as leave with payment from the company, and when can he avail the paternity leave?

Dear Mr. Negi,

It depends on the limited company whether it is allowing any paternity leave to its employees on its own or under any agreement with the employee(s). We do not find any labor law allowing this type of leave to the workers or employees.
