Hi All,
I need some help regarding the title above.
My sister had left her company whom she served for 6 months only, where her probation period was not over yet., with immediate resignation. and after serving resignation she worked for 2 days.Then she joined other organisation.
Her appointment order mentions that she will be in probation for 6 months, and the resignation clause clarifies the 1 month notice prior to resignation o/w 1 month salary will be payable.
Although, its not professional but due to some circumstances she had to do that.
Now, can her previous company send her a legal notice??
and if they will send, what could be the remedial measure to escape from it????

Hi Poonam,
Your sister was on probation for 6 months and shel left job during this 6 months and her services were not confirmed in writting.
During probation employee and employer has right terminate services without notice by either side.
No notice is required during probation. Probation means employees on trial therfore continuity of job is not surity.
I believe company will not waste time and energy chasing your sister if theyare wise and good organization because they did neither confirm services not acknowledge continuation of her services.

dear poonam in this case your sister can leave without giving any notice on probation.they will never send any notice for this cause because it will be wastage of time .so dont worry .tks j s malik
