In our company, there are 50 employees, out of which only 5 employees have gross salaries of less than Rs. 10,000. Is our organization applicable under the ESI act?

Dear All,

I want to provide clarification regarding the applicability of ESI to an establishment. In such a scenario, ESI is not applicable.

As far as PF is concerned, in that case, a PF number is necessary if all the employees of the establishment earn above the ceiling amount, i.e., Rs. 6,500/-.

Kindly correct me if I am wrong.

Dear Applicability ESI comes only if your organization - have 20 / 10 coverable employees, whose salary is Rs.10000 & below.

Dear Friend,

ESI is not applicable to your organization as per the new amendment, which states that for coverage purposes, we only need to calculate those employees who are earning less than Rs. 10,000.

Could you please advise if we can be covered under the ESI Act? We have received a notice from the concerned department and have been allocated a number. What steps should we take if we are not eligible for ESI? Your assistance in this matter would be greatly appreciated.
