It's indeed a difficult situation. However, there are a few steps your employee can take to resolve this issue:
1. Contact the Regional Provident Fund Commissioner: The employee should write a letter to the Regional Provident Fund Commissioner of the region where the company was located, explaining the situation in detail. The letter should include all relevant details such as the Employee Provident Fund (EPF) account number, company details, and the issue faced.
2. Legal Action: If the Regional Provident Fund Commissioner is unable to resolve the issue, the employee may need to consider taking legal action. This could involve hiring a lawyer and filing a case in the labour court.
3. Seek Help from an HR Professional: An HR professional or consultant could provide guidance on the best course of action and help navigate the legal complexities involved.
4. Use UAN: If the employee's Universal Account Number (UAN) was activated and linked with his EPF account, he can directly approach the EPFO. The UAN allows the EPFO to directly communicate with the employee without involving the employer.
Remember, it's important to keep all employment documents safe and handy, as they might be required for such processes. It might take some time to resolve, but with the right steps, it's definitely possible.

In such scenarios, the member (employee) will have to prepare an affidavit showing his date of joining the company with evidences like appointment order, pay slip etc. Since it should have happened 12 years back, it may not be possible for him to get a pay slip but he can produce some papers which show that he was an employee. It is also not possible to establish his wages because it should have been paid in cash. But if the employee was covered by ESI, he can get the records of his registration under ESI Act from ESI Corporation. Try these possibilities.
