Re-employment of a Workman Receiving PF Pension

Can we re-employ a workman after they have completed 58 years and are already receiving a PF pension? If it is possible, can we structure their wage breakup (Basic + DA) with a minimum wage of less than 15,001, without PF deduction?

Please provide the rules according to EPF and labor laws.

If someone has retired and settled his/her EPF & EPS, then he/she is an excluded employee as per EPFO. He can be engaged without PF contribution. But if the monthly gross salary is below INR 21,000 per month, he is eligible for ESI.

EPF Contribution Rules for Employees

If the salary is above 15,000/- and he/she has already settled their existing EPF, then they shall be treated as an excluded employee. If the wage is below 15,000/-, then the contribution towards EPF is mandatory.

Please note that if he/she already has EPS and is receiving a pension, EPF contribution shall be mandatory.
