Dear All,

Please clarify. The employee notice period is on 7.5.22. He resigned on 30.5.22. Can I treat the relieving and resigned date the same, since the date is the same? What is the difference between relieving and resigned?

Hi,

Your question is not clear.

The resignation date is the date on which the employee submits their resignation. The relieving date is scheduled after the resignation date, following the completion of the notice period. Sometimes, if the employee is relieved on the resignation date itself, the resignation and relieving dates will be the same. However, the resignation date cannot be later than the relieving date.

  • "The employee notice period is on 7.5.22. He has resigned on 30.5.22." What do you mean by notice period? Is it not a period, say, one month, two months, or three months, that an employee should serve the company or remain with the company after submitting his resignation? In my knowledge, it is a period and not a specific date, like 7-5-22.

You have mentioned that he resigned on 30-5-22. What does this signify?

Moving on to the next part of the question, the resignation date and the relieving date may or may not align. The resignation date is the day the resignation is submitted. For example, if I inform you today that I intend to leave the organization and will be available for handover for one month (the notice period), today is considered the resignation date. If you are scheduled to be relieved on 14th October 2023, which is one month after the notice of resignation, then the relieving date would be 14th October 2023. However, this date could vary depending on circumstances. The actual day on which the employee is relieved of duties and responsibilities is the relieving date.

If it is decided that the notice period is not required, and the employee can be relieved on the same day as resignation, then the resignation and relieving dates will match.

In a relieving letter or experience letter, both dates will be specified, for instance, "You have been relieved on [date] following your resignation dated..." or "He was relieved from his duties on [date] following his resignation dated..."

If the resignation date and the relieving date coincide, or if they are very close, it could indicate that the employee did not serve the notice period, or the resignation was involuntary due to performance issues.
