When it is not possible to carry on the activity itself due to no one's fault, the usual share of one's return cannot be expected. But the plight of everyone, be it the State, employer, employee, or the general public, under the continued pressure of the worldwide lockdown needs to be considered with a holistic humane approach both as a matter of principle and expediency. If we analyze the concept of layoff contemplated by the Industrial Disputes Act 1947, we can realize the above truth, however bitter it may be.
I am not suspicious about the intention behind the introduction of Fixed-Term Contract Employment into the Statute Book. Rather, my view on this attempt is to ensure proportionate employment benefits to such employees on par with their regular counterparts. But the complete removal of the restrictions stipulated in the amended provisions of Central Standing Orders Rules and the non-consideration of the trustworthy regulatory measures adopted by certain economically advanced nations like Sweden on FTC employment while passing the new Labor Codes would certainly lead to the gradual depletion of regular employment and give room for a spate of unnecessary industrial disputes in the long run. Hence, it is imperative that the Government of India should take necessary preventive steps in this regard now itself by introducing necessary amendments to the Code on Industrial Relations, 2020.
