Can a women of age above 40 years avail benefits of maternity leave for removal of uterus in Maharashtra? If yes, then is it specified in the Maternity Benefit Act and for how many weeks.

The Maternity Benefit Act, 1961, aims to regulate the employment of women in certain establishments for a specific period before and after childbirth and to provide maternity benefits. This act may not be applicable to your requirements.

Maternity leave is applicable only where a woman avails leave before and after delivery of a pregnancy. In normal circumstances, removal of the uterus is not covered under the MBAct.

However, in the very uncommon situation where removal of the uterus is necessitated due to a severe crisis immediately following pregnancy, for example, severe postpartum bleeding or rupture of the uterus, removal of the uterus would come under the purview of the MBAct. But removal of the uterus without any connection to a pregnancy complication will not be covered under the Act.
