I have some doubts regarding ESIC and WC policy.
1. Can we take ESIC and WC policies both for contract workmen?
2. Can we benefit from both policies at the same time in case of a fatal accident?
3. Will a claim be applicable from both policies?

Once an employee is covered under ESI, they cannot claim the same benefit under the Employees' Compensation Act or any other act, or under any different scheme. Other views are welcome.

As per the Act, if one is a member of ESIC, it absolves the mandatory requirement of the Employees' Compensation Act and the Maternity Benefit Act. However, where ESIC is applicable, it is mandatory to become a member of ESIC. Both are contributory schemes; hence, as per my understanding, there should not be any bar for benefits in the case of fatality. However, the finality shall be checked with detailed terms of the WC policy.
