I took 84 days of maternity leave for my first and second baby. However, three months after the birth of my second baby, the baby passed away due to a heart problem. Now, I would like to inquire if I am eligible for maternity leave for my third baby. If it is possible, could you please confirm the duration of leave I am entitled to take?

While confirming the reply of our learned member JudeGR above, I'd like to add that as per the amendment to sec. 5 of the Maternity Benefit Act, 1961, the reduction in the 26-week maternity benefit to 12 weeks is applicable only in respect of a woman having 2 or more surviving children. Since the poster has only one surviving child as of now, she is entitled to 26 weeks' maternity leave for the third delivery.

If you are working for the same organization, then you are eligible for only 12 weeks for the 3rd child as advised by Shri Umakanthan.
Madam, if you could permit me and also excuse my statement, I would like to ask you: are you giving birth to your child for your family or what benefit are you going to get under the Maternity Benefit Act? I think for every mother, a child is the most precious gift given by God. You should pray to God for a good and healthy child and nothing else.
