I took 84 days of maternity leave for my first and second baby. However, three months after the birth of my second baby, the baby passed away due to a heart problem. While confirming the reply of our learned member JudeGR above, I'd like to add that as per the amendment to sec. 5 of the Maternity Benefit Act, 1961, the reduction in the 26-week maternity benefit to 12 weeks is applicable only in respect of a woman having 2 or more surviving children. Since the poster has only one surviving child as of now, she is entitled to 26 weeks' maternity leave for the third delivery.
