Dear Sir,

This is to inform you that if an employee has met with an accident and is partially disabled, the company has requested him to take rest as he was nearing retirement. He met with an accident in April, and in November, he is retiring. In his full and final settlement, what is the company liable to pay?

We hire employees who are working with us on a contract basis with a contract agreement made between the Contractor and the Employer. In this case, a contract employee is 62 years of age. If an inspection is conducted, will the employer or the contractor be held responsible?

Till November 2018, he is currently on rest as per the company's instructions, and they have advised him to take a break. We will handle the necessary procedures during the Full and Final (F & F) settlement. Therefore, we need to finalize his F & F benefits. His retirement date is 8th December 2018.

Dear colleague,

It is unfortunate that the employee met with an accident and is currently disabled, with about 9 months left until retirement. Good HR practice would require him to retire honorably by extending all legal dues - full salary from the date of the accident until the date of retirement, leave salary, gratuity, PF, etc.

Treat him with respect and do not only focus on the legality.
