I want to know one thing, please help me. My question is: We have a trading company in FMCG, and we have a total of one thousand plus employees. We have one female CA who wants to take her maternity leave starting from 1st May 2018. The total salary is 45000, with a basic salary of 20000. Can you please suggest how much she should be paid during her maternity leave in this case?

If she has been working with you for 12 months with at least 80 working days in this 12-month period, she will be eligible for maternity leave of 26 weeks, along with a one-time payment of Rs 3500 as a medical bonus. This medical bonus is not required if you have arranged for her prenatal and postnatal care. The 26 weeks of leave should be paid at the same rate of salary that she has been receiving, i.e., Rs 45000.

If company pay her only Fixed Basic ?(20k)

I didn't understand your question. I mentioned earlier that if her salary is Rs 45000, regardless of the basic pay, she should receive Rs 45000 for 26 weeks. Now, you are inquiring about her basic pay being only Rs 20000. Why is that? If you intend to convey that her fixed salary is only Rs 20000 and the rest is performance-based incentive, then you can exclude the variable part and pay her Rs 20000 monthly. Since she won't be working during her leave days, she wouldn't earn any incentive. However, my concern is why should a Chartered Accountant receive variable pay? Is it feasible to assess an Accountant's performance on a monthly basis?

Hi,

One of my employees wants to avail maternity leave. I would like to clarify whether she will be paid by ESIC, our company, or both. Based on my current understanding, I informed her that she would receive payment from either ESIC or the company, but I want to confirm this information.

If covered by ESI she will be paid from ESIC and i not covered by ESI,you will have to pay benefits
