Hello, Regarding the above title, I want to know if any industrial establishment can retrench by forcing the resignation of graduate employees who have worked in the Machine shop as a machine operator. After seven years, the Honorable Labour Court passed an order in favor of the employees' reinstatement with full back-pay and continuity in service. During those seven years, the said employee completed a postgraduate degree in MSW-HR and D.L.L. & L.W. and also obtained registration in Labour Welfare.

In such a scenario, can this industrial establishment provide him with an opportunity to update his educational qualifications and transition from his previous role as a machine operator to the Human Resource Department, considering it as a "Career Opportunity"?

Armed with professional qualifications in HR, you are in a better position to negotiate with the employer. However, it is entirely up to the management to decide where to place you. Since you are entering after a bitter court battle, it may be very difficult for the management to trust and have confidence in you, both of which are essential for entry into an HR role. Perhaps you could start in your previous technical role, and as time passes and their confidence in you grows, the company may consider transitioning you to HR, although this may happen much later.

Regardless, it is crucial to start on a positive note and clearly express your interest to the top management.

Reinstatement as per Labour Court Order will be the guiding factor. The employee will be reinstated in his earlier position prior to retrenchment. After collecting back wages and other benefits, you may consider an appropriate position elsewhere based on your educational qualifications. It may not be advisable to seek a suitable position in the HR department within the present organization.
