Please advise us regarding the forms to be filled and additional documents required for the withdrawal of the PF amount in case of a worker's death. The worker has passed away while on leave.

Will his family receive any financial benefits from the ESIC as well?

Well, in case of death, the employee's nominee or legal heir should apply in Form-20 (to claim provident fund), Form-10D (to claim pension), and Form-5IF (to claim assurance benefits under Employees' Deposit Linked Insurance '76).

Regarding ESIC, as you mentioned the employee was on leave, his family can get funeral expenses. However, I have doubts about whether they will receive other benefits.

In case of PF: Form No. 20 - for PF withdrawal by Nominee, Form 10 D - for benefit of pension for wife/children up to 2.

EDLI: for insurance benefits under the EDLI scheme.

Documents required: Death certificate issued by District Authorities. If nomination is not done by the employee, then forms should be supported by an affidavit of the nominee/legal heirs. Bank savings passbook of the wife and eligible children (of the same branch of SBI/Punjab National Bank or any bank authorized for pension purposes by PF authorities), 3 sets of passport-size photographs of each eligible member under the pension scheme, family details on the company letterhead, Date of birth certificate (in the case of children issued by the school authorities), Certificate of the company declaring that the employee was in the service of the company.

In case of ESI: At present, any family member can claim funeral expenses occurred on a funeral as per the limit. As employee death has not occurred in the course of employment, the family is not eligible for any other benefit under ESIC.

Dear Sir,

Regarding your query on the above subject, the dependents of an employee's family will receive the following benefits in the event of the employee's death during employment.

1. PF: If an employee passes away during employment, the nominee or dependents of the employee can submit Form-20 to receive the PF contribution amount, Form-10D for Pension, and Form 5 (IF) for EDLI Benefit (Insurance Benefit) up to a maximum of Rs. 1,30,000/- from the RPFO/SRO(PF) office. The submission of the above forms should be accompanied by:
1. Death Certificate (Original)
2. Legal Heirs certificate (Original) issued by Panchayat/Revenue Authorities of the area concerned.
3. Savings Bank Accounts of Nominees and Dependents
4. Family Members Photographs (Card Size) and Individual Photographs (03 no's each) duly certified by the authorized signatory of the company
5. Family Members certificate issued by the employer
6. Children's Bonafide Certificate issued by the Educational Institution if they are studying, etc., to receive the benefit from PF.

2. ESIC: In the case of ESIC, the dependents will receive dependent benefits, i.e., 1/5th of the amount received by the Nominee, and the remaining 2/5th of the amount will be received by the dependents based on the salary of the benefit period of the employee. Additionally, Funeral Expenses Benefit @ Rs. 3,000/- will be provided from ESIC after the submission of the relevant documents as mentioned above.

Dear friends,

ESI Funeral expenses reimbursement

A lump sum payment not exceeding Rs. 10,000 towards expenditure on the funeral of a deceased insured person is paid to his nominee or to the eldest surviving member of the family, or if he has no family or is not residing with his family at the time of death, to the person who actually performs the funeral of the deceased insured person. The ESI notification is attached herewith for your reference.

Furthermore, the nominee of the deceased employee will be eligible for gratuity if he has completed more than one year of service, and also eligible to receive the funeral benefit from the labor welfare board.

I just wanted some more clarification on the PF schemes for death cases - If an employee was unmarried and only Form 20 is to be filled (no need for Form 10D). Also, is it mandatory to provide all family members' photographs and details, or are details of only the nominee (Father/Mother) sufficient? Please clarify. Thank You!

Dear sir,

Please provide the return FORM of EPF Form 10D, Form 20, and Form 5 IF. We are confused about submitting the form.

My brother has had a sad demise due to a brain hemorrhage attack. He was only 31 years old. His 28-year-old wife and 2-year-old son are facing some financial problems.
