Hi All,

I am an HR executive in an ITES organization in Kerala. We have taken a 50-seater space in Bengaluru. My query is - what legal compliance should be followed to start a business in our new office space in Bengaluru?

Hi Gayathri,

You will have to take registration under the Karnataka Shops and Commercial Establishment Act, acquire Professional Tax Registration, and, of course, obtain the EISC sub-code.

Hi, Gayathri. You need to avail the following registrations:

- Shops & Commercial establishment certificate
- EPF is not mandatory as it may be covered from the head office
- ESI subcode is required
- Professional tax registration
- Trade license from BBMP

If it is purely service-oriented, then no need for Sales tax registration. However, you may have to update the service tax registration as multi-location at your head office range.

Thank you, Mr. Jeevarathnam.

We have completed the initial recruitment process, and all the candidates have been offered a gross salary of more than INR 21,000. In this scenario, should we register for ESI under a sub-code? Is that a mandatory requirement?

Gayathri

Even if there is any one employee who is earning gross pay of less than Rs. 21,000/-, then it is mandatory. How about security/housekeeping?

There are cases where ESI officials forced organizations to register with ESI even if there is no employee drawing less than the ceiling limit.

Gratuity is applicable for all employees if the organization has employed more than 10 employees in a calendar year.

ESI is applicable only for employees who earn wages of 21,000/- or less.
