Monnet Raigarh had paid me an advance against the salary of Aug 2014. However, it had not settled the differential of 62K even after 1 year. PF deducted from my salary for the said month is on hold, and the company has used my PF in its working capital use. AVP (HR) and President (HR) have given sweet assurances, but they hold no value. Monnet-Raigarh presents alluring figures in the CTC sheet, but in reality, hardly sticks to them after the employee resigns. All the sweet verbal talks from HR turn sour. You are just tossed aside like a cigarette butt. The company does not even file PF returns and ignores the PF commissioner's notices.

I was the General Manager (Logistics) facing such ill-treatment regarding non-payment of salary, CTC, and PF for over a year. Are there any means or ways to address this issue, such as writing to the Company Law Board or the Registrar of the company? Please suggest.

How can you establish this fact? A court or any government agency will ask for evidence before acting. Have you received your PF statement which shows less credit and a salary statement that shows a debit of PF? If so, filing a complaint with the PF Commissioner of the area will be necessary. Send a legal notice to the company.

Interesting comments that make me doubt the sincerity of the post. You say the company has held back your PF and that they do not care for a notice by the commissioner. If the company does not reply or comply with the directions of the commissioner, then the department freezes the bank account and recovers the money. They also freeze the bank account of the directors.

So if your statement is true, then the PF department would do that. And today with RTI being freely used, most department officers will not try to bury a matter of non-payment of PF dues by the company.

If any company comes under the coverage of PF, then they will have to comply with the submission of PF return.

Now, as far as I understand, you have 2 concerns. One - the balance amount of 62K after taking an advance hasn't been settled yet.

Another concern is that PF was deducted from your entire salary in August '14 and used for the company's welfare.

Regarding the first concern, do you have the salary slip of that month showing the advance taken, the balance (take-home) of 62,000 along with attendance details? Here, you need to prove that you were present for a certain number of days in that month and the salary received was not as per the salary mentioned in the appointment/appraisal letter. You need to collect your bank statement to tally the figure transferred from the company. This evidence will help you claim that amount from the employer either through mutual discussion or through the labor court.

For the second concern, do you have any proof that they deducted your PF earlier, either in that month or after that? The proof can be a salary slip, PF statement, salary breakup in the appointment letter, PF form 2, etc. If your concern is only for August '14, then it is possible that they showed your salary as 0 while filing the return and kept the actual PF contributions in the company's account. If this is the case, collect the salary slip of that month as proof and tally it with the PF statement obtained from the PF site.

Please note, if they are not willing to provide the salary slip, try to collect attendance details of that month, which is a crucial factor in resolving both concerns.
