US IT Recruitment isn't a simple concept to explain at a glance. The major role of you as a recruiter is not only recruiting but also selling. You will be provided with bench candidates who are to be placed into companies.
As a recruiter, you need to learn a few major concepts:
1. Types of Visa and their validity
2. Types of taxation
3. Types of Employees
Types of Visa:
a) Immigrant Visa
b) Non-Immigrant Visa
As a recruiter, you need to pay attention to Non-Immigrant visa types the most. They are further classified as:
i) A - allotted to Foreign Government Officials
ii) B1/B2 - for Business, Tourists & Visitors
iii) F1 - Visa allotted for students to only study in the US, not to work. For working, they are provided with:
- CPT - Curricular Practical Training (allotted after 9 months of education)
- EAD - Employment Authorization Document
- OPT - Optional Practical Training
- OPT-EAD - Permission to work in the US after education, granted for a period of 29 months (initially for 12 months with an extension for 17 months)
Dependents are provided with F2, which is only permission to stay; they cannot work or study.
iv) H1 - Temporary Work Visa processed from organizations to an employee who is out of the nation with a period of 6 years (initially 3 years + Extension 3 years). There are four categories in H1:
- EB1 - Highly qualified Professionals (CEO)
- EB2 - 4 years Bachelor's degree + 5 years of experience
- EB3 - Any Bachelor's + 2 years of Experience
- EB4 - Government Employee
- EB - Employment Based
Dependents are given H4 visa, which is only permission for residing in the US; they are not allowed to work or study.
v) L1 - Temporary work visa provided during the time of intra-company transfer; employees are not allowed to change their employer. Divided into 2:
a) L1a Visa granted to candidates who have Supervisory Responsibilities for Professional Staff, e.g., Project Manager.
b) To candidates having a specific set of knowledge of the company's products/services, research system, e.g., Recruiter, Trainer.
Dependents are provided with L2 visa; they have the provision to work if they apply for L2-EAD with a duration of 2 years.
vi) TN - for professional workers of Mexico and Canada.
Taxation is categorized as:
i) W2 - Employer pays all taxes of the employee, including state unemployment tax, FICA, FUTA, IRS, State & Federal Income Tax.
ii) 1099 - An individual is treated as a self-incorporated or a corporation and is paid in an untaxed manner; the individual has to pay all taxes.
iii) Corp-Corp - A corporation pays wages to another corporation or vendor providing workers. Employees work under the payroll of the vendor for the other corporation.
Employee types:
i) W2 Salaried - Offer benefits at subsidized rates, holiday, vacation, 401k, etc.
ii) W2 Hourly - Offer benefits at cost, no vacations, no holiday, no retirement plans.
iii) Subcontractor (Vendor) - No benefits.
iv) 1099 - No benefits (Independent Contractor).
Apart from these, you have to learn regarding time zones.
