Sir,

We are working in a college in Haryana. Most of the employees are paid below ₹15,000, and non-teaching staff below ₹10,000. The strength of employees is more than 25, and there is no PF deduction. Can we obtain ESIC membership? Is there any legal authority to compel the employer to provide ESIC membership as mentioned? Are educational institutes covered under this scheme? Is the non-PF deduction subject to any regulations?

Thank you.

Sir,

Please indicate the name of the place or city and the name of the tehsil where the college in which you are working is situated. In order to get coverage under ESI, you are required to confirm whether the area is an implemented area under section 1(3) of the said Act.

Dear Param Pal,

Your college is in Karnal, Haryana, with a strength of teaching and non-teaching staff exceeding 25. Both the PF and ESI Acts are applicable to your college. In Haryana, the ESI Act extends to educational institutions with 10 or more employees. If you file a complaint with the RPFC and ESIC RO in your area, the respective authorities have to take cognizance of your complaint.
