Hi all,

I have been working in the pharmaceutical industry for the last 16 years at a managerial level (4th). I joined a new pharmaceutical company with their headquarters in Chennai one year ago, based in Delhi as my headquarters. Recently, my GM verbally asked me for my resignation, which came as a shock to me. I inquired with the HR department about their role and the status of my employment as my work portal was locked, and I was not allowed to work in the field. Moreover, my salary for the current month, during which I worked for the full 30 days, was not given. Despite continuous emails to HR, they only directed me to contact my GM for clarification. Upon reaching out to him, he simply replied, "Submit NOC of your zone for full and final settlement." I requested clarification on the authenticity of this instruction from HR, but received no response.

I am a confirmed employee and believe that I am entitled to a notice period, salary, and expenses for the last two months, as no memo of misconduct or poor performance has been provided to me during my 13 months of employment.

Should I consider legal action since neither HR nor the MD is responding to my emails? I am located in Delhi, while the headquarters is in Chennai. How should I proceed with this situation? Your guidance would be greatly appreciated.

Dear DSM,

As per my knowledge, no one can terminate an employee without any issue or reason. Forget about it if the employer or GM has informed you to leave the organization. Put a mail to him asking the reason while marking CC to your HR Head. As all companies need to follow the due process of law, you will get the appropriate reason while doing so.

For workers and employees, the law is strict, and they can go to the labor court. For supervisory persons, they will have to go to the civil court. The maxim "wherever there is a right, there will be a remedy" will strictly apply.

Dear DSM,

Please do not tolerate this nonsense behavior and ask for the reason. Please take this matter seriously and take the required steps regarding the issue. No one has the authority to fire you without any valid reason. Keep management informed, and even if nothing is happening, then approach the civil court.

Take care,
Amrita
