First of all, you have to judge the gravity of misconduct. Termination is the last and harsh action against an employee. If an employer wants to terminate an employee, HR must follow the principles of natural justice. You have to give the employee a chance to justify their conduct. Give them a show cause notice and demand an explanation from them. After receiving the explanation, you may conduct a domestic inquiry against the employee. Communicate the findings of the inquiry officer to the employee. Based on the findings, ask for a written explanation from the employee once again. Depending on their explanation, you may take action against them. Keep in mind that even after following all these legal procedures, an employee can still challenge your decision in the labor office or court.
