Hi,

I want to know the procedure of death benefits in a company. If the nominee is my husband's mother before marriage, is there no right for a wife to claim it? I recently got married, and my husband died when I was 8 months pregnant, i.e., 9 months into my married life. I am a government employee, and I have a few questions:

A) My husband's parents are saying I don't have the right to claim the benefits.

B) My husband's company HR is saying to settle the deal outside with their parents, then only we will give the benefits. I told my husband's parents that I am willing to give them a 1/3 share, even though they have an elder son and daughters living with him. Additionally, they have not stayed with my husband since his studies began in 1999 onwards.

Please give suggestions regarding this case as I have a 3-month-old child to look after.

I hope you have registered your marriage under Section 8 of the Hindu Marriage Act, 1955. If so, you will have the proof to present to the company to establish that you are the legal heir of the deceased. Furthermore, you must provide the details of family members and the legal heir certificate to the HR department of your spouse's company.

Please clarify how you can have a 3-month-old child and be 8 months pregnant. It is confusing. If you provide clarification, our members can guide you in the right direction.

My husband died on Nov 8th, 2013. My questions are:

1) My husband had a father, mother, elder brother, myself, and a 3-month-old son. How are his company benefits distributed?

2) My marriage is not registered, but my husband provided the details of our marriage for company records.

3) In case my in-laws create trouble, how can I avail my husband's terminal benefits without their interference?
