If gratuity is deducted by the company in our CTC salary break-up, but we do not complete 5 years of employment and leave the job in between, say after 3 years, what are the rules? Is the company liable to pay gratuity for the 3 years because the amount was deducted in our CTC break-up? Additionally, what is the legal procedure if the company does not pay the deducted gratuity amount? Please reply.

It's a very useful calculation sheet. As per the Payment of Gratuity Act, the service period of 6 months is counted as one year, and less than 6 months is not taken into consideration. In the given sheet, the service period between 3 to 9 months is counted as half a year, and more than 9 months is counted as a full year. Can you please modify this and share it with the members?

Ya, it's a good calculator for gratuity. But I have to ask a simple question: If gratuity is deducted by the company in the CTC breakup, are we liable for gratuity before completing 5 years on the job? Or not because the company deducted gratuity from our CTC salary.

If you worked 240 days in your fifth year, then you will be eligible for the gratuity. In these eleven months, except Sunday, you worked more than 240 days. Therefore, you are eligible for the gratuity. You can go to the Labour court against your organization.
