I know that the rule for providing NH is that an employee should work continuously before and after the NH. I heard that this is an old rule, but I don't know the current rule for NH. Currently, I am in Tamil Nadu Zone C. Could you please describe the correct rule for this?

For national holidays, employees do not need to work on the previous or next day of the holiday. They must be present for some days. If an employee is continuously absent without providing any information, then they are not eligible.

Hi Naveen,

I would like to quote the clause stated about the availing of paid holidays for an employee:

"Provided that no such employee shall be entitled to be paid any wages for any of the holidays allowed under section 3 other than 26th January, the 1st May, the 15th August, and the 2nd October unless he has been in the service under the employer for a total period of 30 days within a continuous period of ninety days immediately preceding such holiday."

Note: Section 3 is addressing the Grant of National and Festival Holidays.

Hi Syed,

I would like to quote the section in question:

Where an employee works on any holiday allowed under section 3 (i.e., on N & F holidays allowed), he shall, at his option, be entitled to either:

(i) twice the wages; or
(ii) wages for such day and to avail himself of a substituted holiday with wages [on one of the three days immediately before or after the day on which he works].

I hope this clarifies the information for you.

Dear Krishan Kapoor,

If you want to keep your retail shops open on National Holidays and engage your employees, you can do so. However, there is a statutory procedure that must be strictly followed, especially in Tamil Nadu.

There is a form called "Form V-A" - a list of employees working on National Holidays that has to be sent to the respective authorities prior to the holiday. Working employees are entitled to double wages or leave with wages on another day.

Do you know that as per the TN Factories Act 1948, there have been several changes in the forms required for compliance? Here are the updates:

- Form 9 has been removed.
- Form 25 now includes a column from Form 9.
- Form 27 has been newly arranged.
- Form 38 has been eliminated.
- Form 27A has been removed.
- Form 26 has been taken out.
- Form 26A has been removed.
- Forms 18 & 18A have been eliminated.
- Form 18 now combines both Form 18 and 18A due to a new amendment.
- Form 14 has been omitted.
- Form 12 has undergone significant changes.
- These changes are effective from 05-09-2012.

National and Festival Holidays are governed by an independent State Act, and provisions are made in the enactment on the number of holidays as N & F holidays, rate of payment, availment, and other procedures. Please refer to the respective state Act on this.
