Hi Not only Pvt. Ltd companies. All the organisations should remain closed on Oct 2nd in regard with Gandhi Jayanthi.

Hi Ashwini. I do agree with your point. As many of BPO will be working on all national holidays. For that we should take prior permission from labour department

Dear Friends,

I respect the contributions of Mahatma Gandhi. However, there are many freedom fighters like Mahatma Gandhi. Why were they not respected by declaring a national holiday on their birth anniversary? If one might argue that it would result in a loss of productive days, I would like to state that Mahatma Gandhi also promoted productivity. Therefore, his birth anniversary should be respected by engaging in productive work in our organization instead of keeping the units closed.

What all compliance / procedures / approvals we have to take for working on a National holiday i.e. 20th January / 15th August and 2nd October, kindly advise in detail. Regards and best wishes,

Dear Ashwini,

Some days are declared as compulsory holidays by the concerned state government applicable to all companies or firms in that state. It is a public document, and the state government usually publishes it one month in advance, generally in December.

(1) If you wish to keep any of the days from the holiday list as a working day, obtain prior permission from the concerned authority. I am not sure who the competent authority is, but you can find this information somewhere on the citehr site. It is either the factory inspector or labor inspector.

(2) The staff who are asked to work on those "holidays" must be compensated, either with an additional leave on another day or with a day's salary.

(3) Keep the documents regarding prior permission and compensation provided to the staff who reported for duty on that date for subsequent verification by the competent authority.

Dear Aswini,

I fully agree with the opinion expressed by Mr. Pranay. In addition to October 2nd, August 15th, and January 26th, are public holidays. As Mr. Pranay rightly pointed out, each entity must obtain prior permission from the respective state authorities to work on these dates.
