Dear All,
I am new to this forum, and I wonder if someone can help me with the following query. I would like to know how many leaves are eligible for contracted office employees (i.e., peons or drivers) during the year as per the law.

Dear Kau_Pandya,
A very warm welcome to CiteHR!!!
For the contractual employees, the eligibility of leaves is 1 day for CL and 1 day for SL per month. Contractual employees are not eligible for leave encashments. There is no carry-forward process for these employees, and in case of no leaves taken, they can be adjusted against the waiver of the notice period.

If the employees are engaged through a contractor, he shall allow them leave under the law applicable to him. It is not your liability. Instead, if they are your employees, they are eligible for leaves at rates applicable to regular employees or at the minimum statutory rate.

Hi,
Employees under contract or company role are entitled to leave. One day of leave for every 20 days is the entitlement under the Factories Act. Apart from this, Sick Leave (SL), Maternity Leave (for married females), and Casual Leave (CL) are also applicable but are restricted by conditions. More importantly, leave is to be treated as a privilege and not a right.
Thanks,
Bijay

Dear K_P,
It's better if you should first indicate the nature of your establishment - whether it is a factory, shop, mine, hospital, society, or something else. Depending on this information, it will be known which act you are covered under, helping us clarify your position clearly.
