Dear Seniors,

Should the offer letter we release for a shortlisted candidate contain the terms and conditions of employment, or can the terms and conditions of employment be given with the appointment letter released later (on the date of joining)?

Subramanian,

Terms and conditions specific to joining have to be mentioned in the offer letter that you release. The terms and conditions followed by your company after the shortlisted candidate joins can be provided at the time of joining. I hope you have understood what I meant. You can reach me at for further clarifications.

Hi,

I was going through this very old post. Can anyone guide me on what terms and conditions should be mandatory in the employment letter? Any format would be helpful, or you can suggest the mandatory titles.

Regards,
Siri

Dear Siri,

In the first paragraph, you can explain about your offer of employment and the department/post being offered. Following that, details regarding the Compensation Package, Working Hours and Holidays, Leave entitlement, Separation Procedure and Notice period, Other Benefits being offered, Statutory Deductions, Medical Facilities, and any other facilities provided to the candidate should be clearly spelled out. You can also provide information on where to report for duty and whom to contact upon joining. Finally, at the end of the Offer letter, you can request the candidate to submit a signed copy of the same, acknowledging their acceptance of the offer along with the expected date of joining.

Thank you.

Thanks a lot for the response Sir.
Also can you help me out in understanding if i need to include something like Confidentiality and Non-Disclosure Agreement / Non–Competition and Non-Solicitation Agreement

Dear Siri,

These are also what you can include in your offer of employment. However, if you add a non-competition and non-solicitation agreement, you may not attract talented candidates to your organization.

Thank you.
