Hi all,
I'm working with one of the IT giant companies for the past 7.5+ years. At the time of joining, the notice period was 45 days. Last year, HR sent an email to the entire office stating that the notice period is revised to 90 days. I have resigned, am currently serving the notice period, and have already completed 45 days. I requested an early release, but I have not received any reply to my email.
My question is: Can a company increase the notice period of old employees without having them sign a new agreement? I am willing to pay one month's salary, but if the company still does not agree, do I have any legal options? Please advise, as I am really puzzled.
Thanks

Unless you have signed the new aggreement company cannot force you to server 90 days. I would say you dont have pay money for 30 days. You have right to get release in 45 days.

Thanks, buddy. Can I get more suggestions from the fellow members? I just talked to my lead, and he says I'll be marked as absconding if I quit without serving a 3-month notice period. I talked to the recruiting company, and they are not in a position to extend my joining date. If I serve the notice period of 3 months, it will leave me jobless.

Please go ahead and explain to your head why you can't give 90 days' notice. Since you have not signed anything, it is not binding on you. Legally, they cannot take any action against you.
Please first try to get an amicable solution to the problem. If they don't agree with it, you can always go to the labor court. But it should be your last resort.

Thanks buddy. I've informed HR about my genuine issues, but I'm not receiving any replies to my emails. I'm currently at a client site in a different country, and even though I requested an early release two months ago and asked them to initiate the process of visa cancellation, I have not received any responses from them to date, despite sending repeated reminders.
I am now arranging to return on my own tickets, and it doesn't appear that I will receive a clear release. Please advise me on what steps should be taken to resolve this matter. I am unsure how to approach the labor court. I have been attempting to contact HR via phone, but they are not responding. All of this is contributing to my frustration.
