Is there any provision in PF act that Employer provident fund contribution will be returned if employees not stay more then seven month

I think an employee and employer will be happier if they settle the employee PF on time. Nowadays, it's very difficult to get the PF claim from the government when you are talking about the refund. Personally, my provident fund is stuck in the EPF Office Bandra for the past 3 years and has not yet been settled, even after applying 4 times. Any suggestions on how to get it are welcome.

I think you had taken the wrong train. My question is, is there any provision to retrieve the employer's contribution that has not been claimed by employees or labor after resignation. If there is such a provision, could you kindly provide your answer.

In 2005-06, I worked at a company for 10 months and was contributing to EPF. Upon leaving, I applied for complete withdrawal for the 10 months and received a cheque from the EPFO 6 months later, well into the next financial year. The reason for the delay, as explained by the PF authorities, was that the interest for 2005-06 had not been determined by the Board.

You must ensure the following:
1. Your form for withdrawal is correctly filled with your PF Account number.
2. Your employer has remitted the correct amount to the PF quoting the relevant account numbers.
3. An acknowledgement that the PF office has received your application.
4. If the above is done, please send a reminder to the PF Office and get an acknowledgment AGAIN.
Three years is too long to wait for your PF money. Seek an appointment with the PF Commissioner, and if this is in vain, file an RTI or approach the courts.

You are totally right. If any person submitted his PF withdrawal form to his organization, he can claim his acknowledgment copy from his employer to understand his PF status. Afterwards, he can follow up with the PF department with this acknowledgment copy and ask for his PF amount. At the same time, if he faces any difficulties, then he needs to contact the PF commissioner of the PF department.
Kindly confirm from your organization your PF status and at the same time ask for an acknowledgment copy. Alternatively, you can also check your PF status online (if you know your PF Account no and establishment code).

Provident fund can be claimed at any time after two months from resigning and before the expiry of 36 months or 3 years. To process your PF, it will take a maximum period of 6 months. The government will give you interest at 8% on the total amount of your provident fund.
