I have been working in a Pvt Ltd Company for 4 years. Recently, I have submitted my resignation as I am venturing into business. However, since I signed a 5-year service bond when I joined as a fresher, they are not accepting my resignation. I have decided to move forward even if they do not accept it.

I kindly seek your advice on the following matters:
1) How can I withdraw my PF amount (for 4 years) and what is the procedure to obtain it from the PF Office?
2) What steps should I take to receive my Gratuity amount and a relieving certificate from my company?

Hi Ramesh,

First, you need to obtain a medical certificate stating your inability to work. Then, you should send it to both your company and the ESI office. The company will automatically issue you a relieving certificate. If the company fails to provide the relieving certificate, you should seek advice from a lawyer. Once you receive your relieving certificate, you can easily claim your PF amount.

After two months from your relieving date, you can apply for PF settlement. Your gratuity will be disbursed automatically by the company.

Dear Ramesh,

Once you have to sign an agreement with a company, it means you have to abide by the agreement. What is the reason you have mentioned in your resignation letter? Please provide full details.

Once they have not accepted your resignation, how can you demand your relieving certificate? There must be some logic in your demands.

As you have not completed five years of service, you will not receive your Gratuity. Your PF can be claimed after the submission of Form 10 from your employer. They will submit Form 10 only after accepting your resignation.

Dear Sir,

Thank you for your replies. The reason I have provided in the resignation letter is being medically unfit. I have also undergone medical treatment for a period of one month with permission. If they do not accept my resignation, can I still receive my PF amount?

Dear Ramesh,

When did you leave the organization? If you left before April 2011, you can submit your PF Claim directly to the concerned PF Office using Form 10C and Form 19. Please include the following documents: the first page of your Bank Pass Book or a canceled cheque leaf, your latest pay slip showing your PF number and PF deduction details, and the previous year's PF slip issued by the PF Commissionerate.

The PF Office will obtain Form 10 from your previous employer. Make sure the forms are attested by a Nationalized Bank before submission.

Mr. Ramesh,

There is one option to withdraw your PF: you can transfer your PF amount to your new account where you are joining.

Kindly note, Mr. Baskar, for Form 10 & 19C, the current employer should sign. If they do not, the PF office case worker will not proceed.

Dear Ramkishore,

The Forms 10C and 19 can be attested by any Nationalised Bank Manager and directly submitted to the concerned PF Office. If not, they can be submitted to the nearest PF Office, and the office will further forward them to the concerned PF Office. The PF Office will then confirm the date of relieving/last date of working, PF recovery details in the current financial year, and upon receiving the details, it will start processing the claim and remit the amount to the concerned bank account.
