Hi,

My husband resigned from a company 2 months before. Actually, his notice period is 30 days, but he served only 15 days. The company needs to settle my husband Rs 78,000 (includes Medical benefits, incentives, etc.), but they didn't as he didn't serve the notice period. However, they accepted to settle Rs. 16,000. But still now the company hasn't settled his amount. How can we claim this amount?

His PF form was sent a week ago. Only yesterday, he couriered the PF Form to his head office in Mumbai. Is there any specified days or months that the PF amount should be settled?

Kindly help with these 2 queries, please.

1. The entitlement during the settlement depends upon the following:
a. Notice period required to be served as per the terms of the appointment
b. Loans and Advances taken from the company
c. Assets under the possession and returnable to the company
d. After recovering the dues from the entitled salary and perks, the rest shall be paid, and you can recover it under law.

2. For the amount of PF, you need to submit Form 19/10c after 2 months from the date of relieving from this company to the HR department of this company. They will forward it to the PF Department, and you can get the PF within 15-20 days from the date of deposit of PF Forms in the PF Office. Don't forget to attach a copy of the cancelled cheque along with the PF Forms.

After 2 months of his resignation, an employee can submit his PF withdrawal forms, Form 19 & 10c, to his employer for withdrawal. If your husband has done things perfectly, ask for an acknowledgment of submission from your employer to confirm that the forms have been submitted to the PF Department.

Anurag jain After the PF form Submission it takes 3 month’s i.e 90 day’s to get the amount credit to the Bank account .

Ravi, you are talking about the old days. At present, the PF department releases the fund in 15-20 days after the submission of the form. To make it possible, they are now demanding a cancelled cheque and a copy of the bank statement for crediting the amount into the correct account for the correct person.

I am working in the staffing industry for the entire western region as the Manager for compliance. PF submission is our routine activity. Until now, there has not been a single case that has been settled within 15-20 days by providing all the details to the PF department.

Hi dear,

PF Form 19/10 can be submitted immediately to the HR department. You can either deposit the PF form at the PF office or the company. Don't forget to enclose the last three months' bank statements. The PF department processes PF requests after two months from the date of leaving, while the PF office usually takes at least one month.

if company is depositing the PF form to PF office then don’t forget to take the acknowledgement from company...

Hi Ravi, I am in the rajasthan region and now a days the PF refunds are normally transfrered in the account in max 20 days. I dont know why so in that region.

Dear Kavita,

If the notice period is one month, and he served only 15 days, then the employer can deduct 15 days' salary and settle the full and final account. They cannot say that the full and final account cannot be settled. Ask them to deduct 15 days' salary and settle your husband's full and final dues. For PF, go ahead as friends above are advising.
