Dear all,

My company is covered under the provisions of ESIC. However, suppose a visitor comes to my company and during the factory tour, he unfortunately meets with an accident and dies. In such a situation, what can a company do? Is the company legally liable for any compensation, or can the company claim any benefits under the ESIC?

Hi Ashok,

How are you?

Ashok, there is an act called the Public Liability Act - under this act, the employer has to take an insurance policy for the outsider who comes to visit the plant or work site. This insurance also covers property.

You can find the act on Google and go through it to enhance your knowledge.

You need to take out an insurance policy named Public Liability Policy - Non-Industrial. You can check with your insurance provider, and they will guide you. It covers all your visitors who visit your premises.

Please let me know if you need any further assistance.
