As far as I know, overtime can only be demanded by workers if they are under the Factories Act or Shops and Establishments Act. However, my organization does not come under either act. The workers are wanting overtime. Does the management have to pay?

Dear Member,

If either of the Acts is not applicable, then refer to the Minimum Wages Act, 1948 for payment of overtime (Section 14).

Yes, I have done the same. My organization is under the Minimum Wages Act. In that case, do we have to pay overtime, or can a collective bargaining be arranged to make them agree to our demands of no overtime?

If the employer does not want to have employees work overtime, then the employees cannot force him to assign overtime work. If you choose to work overtime, you will need to comply with the regulations outlined in this Act. The Act also sets limits on the amount of overtime that can be taken.
