We want to remove an employee from ESIC because the employee is exempted from ESIC, but contribution was paid the previous month. Also, what is the procedure for removing the employee from ESIC? Kindly suggest in this regard.

while paying contribution for oct, you can file zero in wages column reason 4 (Out of coverage) and last working day as 30/09/2020 from next month his name would not appear

It is deemed that the September 2020 contribution was paid in October. Now, the procedure will mark the employee as off on 30/09/2020, from the ESIC portal only. Legal issues are not associated with the ESIC portal application.
