Hi,
There are two ways: one is withdrawing the amount, and the other is transferring the same to a new account.
For withdrawal, the process is as follows: the employee is eligible to apply after 60 days from their date of resignation.
Regarding transfer, the employee can apply immediately with the help of their new employer after joining the new organization.
You can download the formats from www.epfindia.nic.in.
Withdrawal forms are Form No. 10C and Form 19.
For transfer, the form to be used is Form 13.

There are three other forms, e.g., Form No. 5, 10, and 3A. On Form No. 5, you will mention your date of joining in that organization. Form No. 10 is for the mention of the date of leaving, and Form No. 3A is for those who were working after April (for the current year).

Hi Ankitha's clarification is, if the employee resigns and wants to get the PF amount back, then the formalities are either withdrawal or transfer. I hope I have replied to the same. Your information is different, but it is correct. Form 5 is for new joinees, form 10 is for resignees, and form 3A is for annual returns which this particular work has to be taken care of by the HR person or the company's PF consultant. This will be done every month along with PF remittance. Correct me if I am wrong. Thanks.

To take back the PF amount, the employee has to complete his relieving formalities with the organization in good condition.
1. An employee is eligible for PF claims after 60 days from his Date of Leaving (DOL).
2. If an employee has any dues to the company, he has to finalize that first and then apply for withdrawal. The reason is that he cannot apply without the employer's authorized signature.
3. The rule states that the organization cannot hold the employees' amount, where they can file a case. But in your case, I think you can speak to the employee personally and ask him to settle the amount with the company, then apply for the PF amount. This will help him maintain a smooth relationship with his ex-organization.

Please note that you need to talk to the employee in a very affectionate manner to recover the amount from him. Ask him politely to get his dues clear. However, as far as PF is concerned, and the signature of the Employer (or the other authorized personnel) is required on Form 19 & 10 C. You cannot hold it as this amount belongs to his dependents. He may withdraw his PF amount by getting his forms signed by other gazetted officials and may file a case against the company.
In the future, please remember to ask the employees to submit No dues forms duly signed by all the concerned departments, viz., functional, store, Accounts, etc.

*Form 6A - Prepare a Consolidated Statement of EPF remittances.
*Form 9A - (Important Register) should be submitted in March for the Annual EPF Return.
