Sir, one person in the government sector has been awarded the punishment of "stoppage of two increments without cumulative effect" on 12.06.2016. The person was then promoted on 01.09.2016 and retired on 30.09.2017. How will the punishment be imposed?

Stoppage of Two Increments without Cumulative Effect means he will not get an annual increment for two years, i.e., he would lose his increment for 2017 and 2018. But in 2019, he will get the same increment added to his basic pay along with the increment due for 2019. This is only a temporary holding of time scale increment. Had it been like "Stoppage of Two Increments with Cumulative Effect," then he will never get those two increments. In 2019, he will get one increment, which is the increment due for 2017, losing two increments, i.e., the increment for 2018 and 2019.

In the present case, since he has been given a promotion (I am concerned about how an employee against whom a disciplinary action has been taken is given a promotion), there are two possibilities. On promotion, whatever increment is payable to him will be paid only in 2019. Now, since he has retired from service, he should have retired with a basic pay of 2016. In the pensionable salary, this increment will also be on hold, but now the revised pension based on the basic pay of 2016 plus two increments will be released.

The above is not a conclusive answer because I am not familiar with government service rules and their regulations. Therefore, I invite others to share their comments on this issue.
