Sir, the company is going to lock out due to employees' demands not being accepted. What is the first process flow?

1. Do we have to inform the labour commissioner or someone else first?

2. Who should the lockout information be given to, what is the notice period, and for how many weeks?

More details are required. The reason that the management can't accede to the demands cannot be the justified reason for a lockout! Whether the demands are pending before the Conciliation Officer is also a matter to be decided for the application for a lockout.

Instead of a lockout, if the employees have not raised any dispute before the Conciliation Officer, then the management has the right to raise an industrial dispute before the Conciliation Officer and initiate the conciliation procedure. If the demands are unreasonable and if the conciliation officer is fully satisfied, he may either refer or not refer the dispute for adjudication.
