Kindly clarify my doubt on Gratuity payment calculation. When an employee availed maternity leave and left the organization after 5 years, and the period of maternity leave is within the 5-year period, do we have to consider those leaves for the calculation of gratuity? I believe it should be considered as a privilege, as the same is provided by the Act for female employees. Please provide your comments!
