In legal matters, there is no scope for suggestions. Find out whether the Maternity Benefit Act is applicable to your establishment and to the woman employee. The Maternity Benefit Act provides for 26 weeks of leave with pay. Please go through the relevant act, rules, and several posts available in the site. For any specific queries, revert.

Dear colleague,

1. The MB Act applies to Commercial Establishments and others if they have 10 or more employees working or who have worked on any day during the preceding 12 months.

2. Maternity Leave (ML) is paid leave granted for 26 weeks, of which 8 weeks are preceding the due date of delivery and 18 weeks are post-delivery.

3. A medical bonus of Rs 3500/- is to be paid in addition to ML.

4. Please read the MB Act for details and follow accordingly.
