Hi, sir,

I worked in the company for 6 months and left due to an urgency, providing a 3-day notice period. I requested a relieving letter and informed them that I would cover any shortfall during the notice period. They calculated my Full and Final (FNF) amount and deducted the shortfall amount themselves. However, they are refusing to issue the relieving letter, citing the short notice period I gave. I have made every attempt to reach an agreement with them.

Should I consider legal action?

Please provide the entire reasons as to why you left in urgency. What was the notice period? Was your resignation accepted? Did you submit a resignation letter? What was the response given by the company? Only then can anyone provide a proper answer. Your query is too vague, and too much is assumed.

Please define "Urgency". What is the notice period as per the appointment letter? Have you submitted your resignation in person and obtained acknowledgment? What legal remedy do you expect? What was your employment position? Have you handed over charge and obtained a "No Dues Certificate"? Are you a workman falling under the definition of Section 2(S) of the Industrial Disputes Act, 1947?

You mean to say that you are ready to pay the legal fees and wait for the judgement to happen, for your relieving letter

Notice pay, if any, is recovered from the salary. If it exceeds the salary, you are required to pay the difference. How do you expect the company to recover that money when you simply vanish from the company, giving only a 3-day notice, right? If you value your salary so much, consider how the employer feels when you depart without a proper handover and clearance.

Your question seems to be about how to recover the salary. Unless you complete your notice period, clearance process, and handover responsibilities, you should not expect any payment. You found a good job elsewhere, which is why you left abruptly, so be prepared if your salary also disappears.
