How to conduct an inquiry into sexual harassment? Firstly, the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act 2013 must be applicable to the establishment. Secondly, there must be an Internal Complaints Committee formed under the Act consisting of 4 persons, with a minimum of 2 women, headed by a woman. The complaint of sexual harassment must be in writing. If not, the ICC must assist the complainant woman in reducing her complaint to writing. A chargesheet must be issued to the Respondent named in the complaint. The inquiry must be conducted following the principles of natural justice, as in any other inquiry. After the inquiry concludes, the ICC must determine whether the Respondent is guilty or not, and recommend to the Employer what action should be taken. The Employer must implement that recommendation. The Respondent or the Complainant Woman has the option to appeal to the District Committee or Court.
