Dear all,

Can you please tell me whether there is any age limit prescribed for employees' ESI and PF coverage? Most of my permanent and temporary staff are aged between 50-54+. Kindly advise me.

Sir, in order to become an employee within the meaning of the ESI Act, 1948, and rules/regulations framed thereunder, there is no requirement relating to the age limit of any person. The person should be employed in insurable employment and receiving wages as per the wage limit notified by the appropriate Government.

Age of an employee is decided by the Standing Order of the Company. Hence all the persons employed as per the S O and drawing wages upto Rs 15000 are eligible.

Your statement shows that an employee working past the age of retirement under standing orders is not covered under ESI even if his salary is less than ₹15000. I think that is an incorrect statement.
