can i take my 3 months maternity leave at any stage of my pregnancy? or is it like 6 weeks before delivery and 6 weeks after??

Hi Anytime prior to six weeks of your due date is permissable. Even you take 12 weeks from the day of delievery. You can always check with HR dept and plan accordingly.

Dear Sir,

Normally, maternity leave is eligible for 6 weeks prior to delivery and 6 weeks after delivery. However, since the exact delivery time cannot be assessed, a total of 12 weeks will be allowed in practice. Please adhere to this guideline.

It should be 6 weeks prior to your expected date of delivery and 6 weeks after the delivery. In some cases, a woman suffering illness arising out of pregnancy, delivery, premature birth of a child, or miscarriage shall, on production of such proof as may be prescribed, be entitled, in addition to the period of absence allowed to her under section 6, or, as the case may be, under section 9, to leave with wages at the rate of maternity benefit for a maximum period of one month.

The act specifies that you are eligible for 12 weeks of maternity leave. Out of this, at least 6 weeks need to be after delivery. So it is not necessary that you take any leave before delivery; you can take all of it after delivery. On the other hand, you can take up to 6 weeks before delivery since the balance has to be taken after delivery. The act allows you to take more leave if there is a medical reason. However, paid leave will only be for 12 weeks. If you fall under the ESIC act, then leave pay is provided by ESIC according to the number of days ordered by the ESIC doctor. The company is not allowed to terminate you for absence or any other reason during pregnancy.

According to the Maternity Act, 1961 - Condition for claiming benefits: Sec 6
• 10 weeks before the date of her expected delivery, she may ask the employer to give light work for a month. At that time she should produce a certificate that she is pregnant.
• She should give written notice to the employer about 7 weeks before the date of her delivery that she will be absent for 6 weeks before and after her delivery. She should also name the person to whom payment will be made in case she can not take it herself.
• She should take the payment for the first six weeks before she goes on leave.
• She will get payment for the six weeks after child birth within 48 hours of giving proof that she has had a child.
